County foreclosures to go faster

DAYTON — Montgomery County officials on Friday, July 16, approved an expedited foreclosure process for abandoned, tax- delinquent properties.

The three-member county board of revision unanimously adopted the procedure, which is used only on uninhabited homes.

During the same meeting, the board also approved the first-ever use of the procedure, initiating the seizure of 31 empty properties in the city.

Karl Keith, the county auditor, said the move will shorten the foreclosure process from more than two years to about seven months.

The accelerated foreclosure process should ease the burden on the courts and put abandoned properties back into use more quickly, Keith said.

In 2006, Ohio law was changed, allowing county boards of revision to acquire vacant homes with unpaid taxes through an expedited foreclosure.

Under the procedures approved Friday, the board approves a list of properties and submits it to the county prosecutor. The prosecutor files a foreclosure complaint with the clerk of courts. The clerk notifies the property owner, who can dispute the action.

The board also agreed to submit a list of vacant homes in the neighborhood around the city of Dayton’s Rec Plex that are slated for foreclosure.
